Edward Cole practices in the areas of real property litigation and environmental regulation. Edward represents property owners and lenders in environmental regulatory litigation, title insurance litigation, property rights disputes, landlord-tenant actions and commercial foreclosures. In his environmental regulatory work, Edward represents landowners and other private parties before state and federal permitting agencies on wetlands, water use and endangered species issues, including representing wetland mitigation bank applicants and sponsors in Florida and other Southeastern and Gulf Coast states.
 

 
Litigation
 
Water Use Permit Challenge - Representation of owner of a 55,000 acre tract in administrative challenge of proposed water use permit for municipal utility well field, including four-week administrative hearing.
 
Title Insurance - Representation of owner of a 6,500 acre tract in title insurance litigation to recover damages from utility easement encumbering 120 acres of client's property.
 
Foreclosures - Representation of lenders in litigation against borrowers throughout Florida, including foreclosures of agricultural/timber tracts, development tracts, commercial properties, gas stations, industrial sites and contaminated/brownfield sites, and pursuit of borrowers and guarantors for deficiencies.
 
Distributor Litigation - Representation of distributor in arbitration with manufacturer over wrongful termination, including representation in six-day arbitration hearing before three-member AAA panel.
 
Constitutional Challenge - Representation of owner of wetland mitigation bank as intervener in Louisiana State Court action supporting constitutionality of legislation prohibiting State from using state funds to take private property for wetland mitigation.
 
Developer-Association Litigation - Representation of condominium association in state court action seeking turnover of stormwater permit and facilities on which developer proposed to construct hotel.
 
 
Environment & Natural Resources
 
Brick Road Mitigation Bank - Representation of landowner in obtaining state and federal authorizations for 3,000 acre wetland mitigation bank in Northeast Florida. The Brick Road Mitigation Bank was the first authorized by the Jacksonville District under the new federal rule for Compensatory Mitigation for Losses of Aquatic Resources.
 
Panama City Annexation and Land Use Change - Representation of owner of a 98,000 acre tract in annexation of 3,000+ acres into The City of Panama City, amendment to City’s comprehensive plan and litigation with former Department of Community Affairs over consistency of comprehensive plan amendment.
 
Bear Creek Mitigation Bank - Representation of owner of a 98,000 acre tract in obtaining state and federal authorizations for 3,000+ acre wetland mitigation bank in Florida’s panhandle.
 
Mitigation Bank Loan Transactions - Representation of lenders in multiple loan transactions to wetland mitigation bankers secured by mitigation banker's state and federal authorizations and mitigation credits.
 
Carbon Credit Project - Representation of timberland owner in development of first of its kind forestry carbon offset project on 20,000 acres in New York and Pennsylvania. The project generated both managed forest offset credits and long-lived wood products credits and was the first forest carbon offset project approved by and registered with the Chicago Climate Exchange (CCX).
 
Florida Forever Sale - Representation of family partnership in sale of conservation easement to Northwest Florida Water Management District under Florida Forever program.
