Pete Morrison is a partner in the Labor & Employment Practice Group. An experienced litigator, he regularly represents clients in federal and state court jury trials as well as multi-forum actions and emergency injunction proceedings across the U.S. He prosecutes and defends claims for breach of non-compete agreements, breach of contract and fiduciary duty, unfair competition, and trade secret misappropriation. Pete also defends discrimination and harassment claims involving race, pregnancy, sex, national origin, age and disability, retaliation, wrongful discharge, fraud, defamation, and claims under ERISA, NLRA, FLSA, and all discrimination and employment statutes. He has experience working with employers in various industries including, healthcare, securities, financial and professional services, insurance, manufacturing, transportation, telecommunications, retail, direct marketing, food service, and restaurants.

Pete provides counsel on a range of labor and employment issues for both unionized and non-union employers including, discharge and discipline, disabilities accommodation, harassment and high level internal investigations, employment contracts, separation agreements and union collective bargaining agreements, union organizing campaigns, double-breasting, drug testing, subcontracting, strikes and picketing, plant closings, and compliance with WARN and other federal, state, and local laws regarding civil rights and employment.

He has served as lead counsel representing employers in arbitrations under the labor, commercial and construction rules of the American Arbitration Association, the New York Stock Exchange, the Financial Industry Regulatory Authority (formerly, National Association of Securities Dealers), and the Federal Mediation and Conciliation Service. He also has handled administrative hearings before the OFCCP, DOT and various state agencies, proceedings before the EEOC and state human rights commissions, and proceedings before the NLRB. He has appeared in actions in state and federal trial courts throughout the U.S. and has been appointed Special Assistant Illinois Attorney General and Special Assistant State's Attorney for Labor Litigation.

Obtained defense verdict on behalf of bottler in jury trial on race and age discrimination claims by terminated sales representative.

Won dismissal of claims against medical center in claims brought by discharged employee for violation of the Family and Medical Leave Act and for retaliation for whistleblowing under various federal and state laws.

Awarded summary judgment on behalf of armored car company in claims brought by discharged technician alleging national origin discrimination, harassment, and retaliation.

Won summary judgment for telecommunications company in claims under ADA brought by three terminated employees who suffered from obstructive sleep apnea, narcolepsy, and other sleep disorders and in a claim for religious and race discrimination.

Obtained early dismissal of telecommunications company in nationwide race discrimination class action.

Awarded summary judgment for telecommunications company in claim brought by terminated sales representative claiming pregnancy, disability, and sex discrimination when terminated while undergoing in-vitro fertilization procedures.

Obtained dismissal of Catholic hospital in class action sex and pregnancy discrimination claims.

Won summary judgment in claim brought by a terminated employee alleging race discrimination, harassment, and retaliation.

Obtained dismissal and sanctions for staffing company in claim of disability discrimination brought by plaintiff whose job offer was revoked after having a heart attack.

Awarded summary judgment on behalf of publisher in action for retaliatory discharge brought by employee discharged a few days after informing the employer of her workers' compensation injury.
 
 
Non-Compete/Trade Secret/Injunction Litigation

Defeated claims of trade secret misappropriation and breach of non-competition covenant and confidentiality agreement brought by major commodities exchange against head of risk management operator who moved to a competitor.

Representation of farm machinery manufacturer in successful prosecution of claims of inevitable disclosure of trade secrets against former senior executive who moved to competitor in a senior executive position.

Awarded judgment and sanctions against plaintiff in representation of chief technology officer and new international on-line travel agency in claims of conspiracy and breach of non-solicitation covenants.

Won trial of action on behalf of computer company and newly hired employees defending claims of trade secret misappropriation, breach of fiduciary duty, breach of confidentiality agreements, tortious interference with business relations, and conspiracy.

Obtained verdict in trial of action for damages defending sales representative company for breach of a covenant not to compete.

Defended investment firm and 17 newly hired traders in dismissing claims for injunction and damages where all floor brokers, traders, and clerks moved en masse to another firm.

Representation of investment bank in dozens of injunction and arbitration proceedings involving claims of unlawful solicitation of customers and breach of fiduciary duty.

Representation of surgicenter in prosecuting a claim for specific performance of a stock repurchase agreement and defending counterclaim for wrongful discharge and breach of employment contract.

Obtained dismissal of claims against bank in claims brought by former employee under the Electronic Communications Privacy Act and other eavesdropping laws.

Defeated claims seeking $12 million brought by 35 former employees for age discrimination, breach of contract, fraud, fraudulent conveyance, intentional interference with contractual relations and violation of RICO on behalf of steel mill and its owners.

Awarded summary judgment in defense of steel mill in claims under §301 of the LMRA for wrongful discharge, violation of a collective bargaining agreement, and retaliatory discharge.
