Joshua Mandell is a partner in the Litigation Practice Group who focuses his practice on commercial, financial institutions, and business litigation. Josh represents clients in all aspects of commercial disputes, including breach of contract matters, fraud claims, lender liability issues, and business torts. He represents financial institutions, secured lenders, commercial landlords, property owners, and real property receivers in real estate litigation matters. Josh also has experience handling matters in state and federal court through arbitration.

In addition to his litigation work, Josh is an active member of Akerman's Regulated Substances Practice, which provides counsel to clients on the complex legal and business issues impacting companies with interests in the medical and adult-use cannabis industries.
 
Representative Experience

Developer - Co-counsel in jury trial resulting in verdict in favor of a prominent developer of adaptive reuse projects in downtown Los Angeles. The jury awarded the client compensatory damages of $9.7M for claims of breach of oral partnership agreement, fraud, negligent misrepresentation, and breach of fiduciary duty. Additionally the jury awarded punitive damages in the amount of $3.9M.

Developer - Represented prominent real estate developer in arbitration matter where claimant dismissed proceeding seeking specific performance of real estate purchase and sale agreement during proceedings.

Pro Bono client - Represented pro bono client before the Los Angeles County Assessment Appeals Board regarding the amount of property taxes he owed after he was scammed out of title to his home by a conman.

Shopping Mall Owner - Represented owner of prominent Los Angeles shopping mall in complex construction defect case involving water intrusion.

Developers - Represented multiple entities sued by bank seeking to enforce its security interests in accounts receivable of its defaulted borrower.

Mortgage Lender - Represented national mortgage lender, and federal agency as receiver over a failed thrift, in multiple residential foreclosure-avoidance lawsuits.

Partners - Represented multiple siblings in partnership dispute with fellow general partner engaged in self-dealing.

Receiver - Represented state-court receiver in multiple matters, including the management and eventual sale of a prominent shopping center in Orange County, California.

Investment Fund - Represented investment fund that acquired bad loans from the FDIC by obtaining $10M judgment against guarantor of defaulted loan and judgment authorizing court clerk to execute deed of trust in the name of defaulted borrower.

Investors - Represented investors, as buyers, in litigation concerning complicated purchase and sale arrangement of prominent commercial building in Los Angeles where sellers refused to return refundable deposit of $5M.

Investor - Obtained early settlement on behalf of an individual who was misled into investing $1M in a company, including an agreement to repay, with interest, the client's entire investment.

Employment - Renegotiated the terms of a settlement agreement with a client's former employer leading to a seven figure compensation.

Aircraft Parts Purchaser - Obtained dismissal for lack of jurisdiction on behalf of a client sued for the alleged non-payment of a purchase order in California.

Easement Dispute - Successfully upheld easement rights on a longstanding agreement between the original owner of client's commercial property and the owner of the adjacent lot.

$4M Judgment Enforcement - Obtained a court order directing the opening of a safe deposit box, and an order assigning debtors' rights to the loan value of four life insurance policies exceeding $100,000.

Pro Bono - Obtained settlement on behalf of a client facing eviction from his home, which he had conditionally transferred to his son. The settlement enabled the client to share equally in the profit from an agreed sale of the house.
